Update as of May 20, 2008: The processing of claims has been delayed by the filing of an appeal by four class members who objected to the settlement. The appeal has not yet been decided by the appellate court.
This is the official Court website for the Froeber v. Liberty Mutual Fire Insurance Company, an Oregon case involving PIP and MedPay claims under auto policies issued by Liberty Mutual and several affiliates. The processing of claims has been delayed by the filing of an appeal by four class members who objected to the settlement. Under the Settlement Agreement approved by the Circuit Court, the objectors’ appeal postpones any distribution or implementation of the settlement until the appeal has been resolved. If the appellate court system denies the appeal and upholds the settlement, then the processing of any claims will be completed within 180 days after that decision becomes final and is no longer subject to further review by a higher court. If, on the other hand, the appellate court grants the appeal and overturns or materially modifies the settlement, then the Settlement Administrator will handle any claims as directed by the Court.
